We have acted both for local authorities and developers on housing schemes from small sites with a few high value dwellings through to large sites with thousands of dwellings with a mix of tenures. We have experience in negotiating and drafting planning conditions, section 106 agreements and nomination agreements to suit all styles and size of residential scheme.
We acted for a London Borough Council on the grant of planning permission and negotiating and drafting a complex section 106 agreement for a residential led development for 10,800 new homes including a significant proportion of affordable housing.
We advised a developer seeking planning permission for four high value dwellings in an area of outstanding natural beauty where there were bats present on site and a bat licence therefore had to be obtained.
We helped a developer to obtain planning permission for several residential schemes, negotiating and drafting unilateral undertakings for them dealing with issues such as payment of monies and removal of onsite parking rights for residents.
Listed Buildings and Other Protected Sites
When seeking to do works to a protected building or site it is important to make sure that you have obtained all the necessary consents to avoid accidentally committing a criminal offence. We often work with buildings that are listed or sites that are protected and can help advise you on your responsibilities.
We acted for a hospital trust in the south of England advising them on the potential listing of their building and successfully prevented the building being listed which made it much easier for them to proceed with their plans to redevelop the site.
We advised a developer who wished to develop a site within a conservation area, what he could do within the terms of the existing consents for the site and negotiated a new unilateral agreement for him to extend the period of time between demolition of one of the buildings and reconstruction of a new building on the site.
We acted for English Heritage in objecting to a planning application for a tall tower that would impact on protected views of St Pauls Cathedral. This included representation at public inquiry.
